Purpose. The paper considers the establishment of the paradigmatic determinants of the understanding of crime on the basis of fundamental changes in understanding of the essence of a man in ancient, medieval, Renaissance, modern and postmodern philosophy. Theoretical basis. The author determines that the understanding of the concept of crime is possible only in the combination of historical, philosophical, legal and sociological approaches. The interpretation of the essence of this concept dynamics and relevant legal practices is based on structuralist, post-structuralist (...) and hermeneutical methodological principles. Originality. The author has proved that the concept of "crime" is not a constant but a historically variable category whose dynamics of meanings is linked to a change in philosophical anthropological paradigms. Its understanding is primarily related to the interpretation of the essence of a man and the imperatives of his behavior. This allows a new understanding of the philosophical foundations of modern criminology. Conclusions. The article establishes that in the history of Western philosophy, there are five anthropological paradigms that differ in a thorough rethinking of the essence of a man. The first cosmocentric regards man as a microcosm, his soul and actions must be in harmony with the harmony of the Cosmos. The second Theocentric considers a man the image and likeness of God, though he is at the same time burdened with original sin. In the era of early Modernism, the third paradigm, which we called cognitive-centric, becomes dominant, since the essence of a man is reduced primarily to his mind. It gradually changes to the fourth – sociocentric, which focuses on the social essence of a man. However, despite its continued existence in our time, at the end of the XX century, there is a transition to the fifth paradigm – postmodernist, which deconstructs the essence of a man, reducing it to the role of an element of power systems. These paradigms, with a certain synchronicity, create the corresponding concepts of "crime": from violation of polis-space laws to identification with sin, from non-observance of mental and moral standards to social deviance. Contemporary understandings of crime are, for the most part, relativistic and constructivist, which is consistent with the postmodern anthropological paradigm. However, the diversity of interpretations of the concept of "crime" that exists in the current scientific literature needs further comprehension. (shrink)

A number of scholars in the history of medieval Iceland have emphasized the exceptional importance of law and justice for Icelandic society. According to American researcher J. Bajok, the focus of Iceland's culture was law, and the relationship between Godi and his heirs was also based on law. The nature of Iceland's socio-political institutions reveals the circumstances in which Icelanders' attitudes towards the law were shaped. The royal power in the country during the Commonwealth period did not arise, and the (...) system of chiefs or Godords became specifically the Icelandic institute of government. It is traditionally believed that the country was divided into 4 quarters, consisting of 36 Godords, headed by leaders. The year 930 is considered the date of Altinga's founding. National Assembly of Iceland. Each year, a three-year lawmaker in Altinga had to promulgate a third of the country's laws. The lawmaker selected those who were to sit on the Rock of Law and designate the place where the Courts of the Quarters, which had pending lawsuits, were to be held. The most important institution of Altinga was the Legislative Council, which dealt with legal issues. The council members were 48 leaders or heads. The representatives of the highest level of the religious hierarchy - the bishops of dioceses on the Chamber Hill and the Hills - were also members of the Legislative Council. The bishops participated in three important events for the country: the drafting and adoption of the Law of Tithes in 1096/97, the codification of secular laws in 1117 - 1118, and the record of about 1123 of the Christian Law, which was included in the Gray Law Code. Purpose. The purpose of the research is to define certain interaction features between a human and the urban environment in the global world. Theoretical basis. The study in based on the investigations of contemporary researchers in social philosophy and urban science, as well as social scientists of Chicago School. Originality. The originality of the research is to analyze the "human-urban space" system in terms of the influence of local space of the global world on the human identity formation and preservation. (...) Conclusions. Modern information technologies have significantly contributed into changes in the culture, society, individual consciousness and perception. They have given them absolutely global character and reorganized the value and standard system of the individual. As a result, it caused the identity crisis, so typical of the postindustrial society. This paper examines the use of tablet personal computers and how they interfere with Nigerian undergraduates reading culture and love for educational books. The study adopts a descriptive research design. The University of Ilorin undergraduates constitute the population for this study while 200 level students of three faculties across the university constitute the target population. Stratified sampling technique was used to sample the needed respondents. A researchers’ designed questionnaire was use for data collection. The collected data was analysed using descriptive (...) statistics. The findings revealed that access to tablet computer influence the undergraduate reading culture. Also, 55.7% of 200 level undergraduates read more electronic materials on their tablet computer than printed texts. Based on the findings of this study, it is recommended that students should be encouraged to visit the library and read textbooks since there is certain fundamental knowledge that might not be accessible on the net. The effect of task difficulty on inter-task transfer is a classic issue in motor learning. We examined the relation between self-efficacy and transfer of learning after practicing different versions of a stick balancing task. Practicing the same task or an easier version led to significant pre- to post-test transfer of learning, whereas practicing a more difficult version did not. Self-efficacy increased modestly from pre- to post-test with easy practice, but decreased significantly with difficult practice. In addition, self-efficacy immediately prior to (...) the post-test was significantly lower after difficult practice than easy or intermediate practice. Self-efficacy immediately prior to the post-test, performance at the end of practice, and pre-test performance explained 75% of the variance in post-test performance. The mediating role of self-efficacy on transfer of learning offers an alternative explanation for recent findings on the superiority of easy-to-difficult transfer and may help clarify inconsistencies in earlier research. Thomas S. Kuhn’s theory of normal science (NS), aside from being a provocative philosophical reconstruction of the relatively conservative phase of scientific research, contains useful ideas for systematic analysis of specific episodes in the history of science. Therefore, although the theory has been looked at from different angles since the first edition of The Structure of Scientific Revolutions (TSSR) was published in 1962, its detailed exploration of the cumulative phase of research in mature science is of abiding relevance in the (...) philosophy of science. This is because NS provides a compelling account of how and why members of scientific communities succeed, largely, to produce reliable knowledge about an incompletely known phenomenal world. Again, the theory elucidates special features of scientific research that differentiate it from other creative enterprises. In that regard, this paper reconstructs Arthur Compton’s research into x-ray scattering as a good instantiation of NS. Discussion of Compton’s convincing demonstration of the particulate properties of electromagnetic radiation within the framework of NS showcases the elucidatory power of Kuhn’s theory with respect to selected episodes in science, and corroborates the notion that the bulk of scientific work is a conservative puzzle-solving activity with the potential for precipitating scientific revolutions. To the best of my knowledge, this is the first time that Compton’s groundbreaking work on x-ray scattering has been analysed within the framework of Kuhn’s philosophy of science. (shrink)

The paper addresses the use of heterogeneous ensembles of intelligent unmanned vehicles in such a perspective field of innovations as an unmanned fishery. The issues of joint activity of unmanned vehicles of different types in fishing operations based on intelligent technologies are investigated. The “smart fishing” approach based on the joint fishing operation model is proposed. The operational framework that includes missions, roles, and activity scenarios embedded in the discretized spatial model is presented. The scenario activities are considered as the (...) sequences of pentad that determine executing specific functions concerning the specified waypoint, timepoints, and the states of vehicles. The definition of the plan as the scenario prototype that needs adjusting to the conditions of the situational context is proposed. The coordination problem regarding the joint activities of the unmanned vehicles and their scenarios is defined and the coordination framework based on the distributed common board model and coordination primitives is presented. The prototype of the intelligent scenario-based system including the implementation of both operational and coordination frameworks developed for the control of unmanned vehicles is described. This system makes unmanned vehicles capable to absorb all the latest advances in intelligent technologies to perform smart fishing operations jointly in a large heterogeneous group. The proposed approach to smart fishing using intelligent technologies makes it possible to detach fishermen from the fishing activities dangerous to their life and health, to reduce significantly poaching and illegal fishing, to increase the overall efficiency of fishing operations, and even to save the marine ecosystem. Viktor D. Kudryavtsev-Platonov is one of the most prominent representatives of Russian religious-academic philosophy of the second half of the nineteenth century whose theory of cognition bears an imprint of the Kantian theoretical philosophy. Kudryavtsev was not only thoroughly familiar with the Königsberg thinker’s work, but offered a critically reinterpreted version of Kant’s teaching on space, time and categories of understanding. But was the Russian philosopher original in his reading and critique of Kant? In his later works Kudryavtsev often cites (...) the works of Friedrich Adolf Trendelenburg whose works turn out to be very close to the Russian philosopher. Could it be that Kudryavtsev read Kant through Trendelenburg’s optics? To answer this question consistently I give outlines of Trendelenburg’s and Kudryavtsev’s theories of cognition and compare their views on the basis of the sources. I then draw on archive materials to characterise Kudryavtsev’s acquaintance with the works of Kant and Trendelenburg. It turns out that Kudryavtsev was well-versed in Kant’s philosophical ideas already in the early years of his teaching activities — but not from primary sources, but largely through German historical-philosophical renderings. I establish similarities between the teachings of Trendelenburg and Kudryavtsev on space, time and the categories of understanding and their critique of the relevant Kantian teaching. Finally, Kudryavtsev’s early manuscripts attest to his acquaintance with Trendelenburg’s ideas. I conclude that Trendelenburg influenced Kudryavtsev’s own theory of cognition, a fact that should be borne in mind when reading the Russian philosopher’s epistemological works. (shrink)

There are four main claims to the book associated with these four parts, each of which is divided into sub-themes. Thus, one can denote a number of inevitably controversial ideas advanced by (...) the book. In clarifying the nature of these claims, I can initially respond to some of the main points advanced by various of the helpful review essays in this symposium.Framing the Argument of the BookThe first part of the work posits that there is a fundamental developmental continuity between Old and New Testament revelation, wherein God is revealed first to Israel as the one Creator, and subsequently in Jesus Christ as three distinct persons, the eternal Father, Son, and Holy Spirit.1 This revelation is in turn received in the pre-Nicene era of the early Church, principally under a twofold conceptual format, according firstly to a model of God as a single transcendent subject of wisdom who sends his Word into the world in human nature, and inspires the prophets by his Spirit (the apologists' monotheistic model, exemplified by Justin Martyr) and, secondly, to [End Page 569] a model of economic Trinitarian activity, of the Father, Son and Spirit, who are each divine and one in being, active in sacred history (Irenaeus).2 Nicene Trinitarian authors sought in various ways to find a deeper concordance of the two approaches, one of which emphasized more the immanent unity of God (potentially tending toward a danger of Sabellianism) and the other of which emphasized real distinction of persons active in the economy (potentially tending toward the danger of subordinationism).3 Pro-Nicene figures like Athanasius, Gregory of Nazianzus, and Augustine, among others, paved the way for a mature doctrine of immanent Trinitarian life, in which God was understood to be characterized, mysteriously, by eternal processions of the Word and the Spirit who originate from the Father, and receive from him the plenitude of their deity or divine nature, and thus are equally and identically the one God.4 God is mysteriously three persons who are truly one both in essence and being.The second part of the book is concerned with the theological exploration of what it means to speak of God as one, and of the divine nature of God. Even when I counter by saying, “The Church teaches that something is good because it is good and not because the Church says it is good, and such goodness is grounded in the natural law and a sound anthropology,” such legalism still persists. And so, to read Pruss’s extensive analysis of sexual ethics using both personalist and Thomistic principles as well as what we have received from divine revelation is a much-needed tonic not only for students of theology and philosophy but for all those interested in discovering the role of human reason and biology in crafting a sexual ethic.After an introduction, the proper beginning of Pruss’s analysis is found in chapter 2. Here, the author discusses love and its forms with a particular focus on the meaning of agapē in the New Testament. Pruss argues that, philosophically speaking, we should love everyone. But love should not be understood as monolithic. There are various kinds of love: agapē, philia, and erōs. The New Testament understanding of agapē contains the other two, for it is love itself. This kind of love is a love that loves the other as the other is, for the other’s sake, and in a way that is appropriate to that person in the light of objective facts. Moreover, this kind of love is not simply a feeling or an emotion but is concentrated in an action that is an expression of one’s will.In chapter 3, Pruss takes up the issue of desire. He evaluates desire in two ways: (1) desire and libido, and (2) sexual desire, need, and pleasure. He [End Page 485] concludes that sexual desire is not a need in the same way that we desire food, drink, communication, love, and to be loved. Without these latter, human life would be seriously lacking or, in the case of food and drink, quickly cut short. Second, he observes that circumstances may not be appropriate for fulfilling one’s sexual desire. Finally, while human life would be seriously compromised by the lack of food, drink, communication, love, and the need to be loved, abstaining from the fulfillment of sexual desire even over a long period of time would not be detrimental to human well-being in the same way.Pruss does not imply by the preceding that sexuality does not matter. Chapter 4, in fact, deals with the meaningfulness of sexuality. There are two sets of rules regarding sexuality and its expression. Some rules are moral in nature, like the prohibition against rape. Other rules are customs, for example, the exchanging of rings after the exchange of marital vows. With respect to the moral rules regarding sexuality, Pruss highlights casual sex, sexual assault, gay rights, and romantic love. Apart from sexual assault and rape—both of which lack consent—casual sex, homosexual sex, and romantic love have the following in common, namely, that sex is indeed innately important to human beings and that sex aspires to be romantic in nature. While, as in the case of casual sex, romantic love does not necessarily give rise to true love, romantic love is often the prelude to a deep and unique form of love. Thus Walter Kaufmann reads the quotation as showing how the Christian faith enables its adherents “to indulge their lust for revenge by hoping for the eternal torture and destruction of their persecutors.”3 Weaver Santinello echoes this sentiment when she claims that “‘the great teacher and saint [Aquinas]’ had a ‘bloodthirsty vision of Hell.’”4 Even so sensitive a Christian as Merold Westphal reads Nietzsche’s Aquinas in this way. “[I]t is hard to deny that the spirit of resentment and longing for vengeance burns hot in these passages... in them the final judgment makes the Final Solution seem almost moderate.”5 Similar comments and observations so abound in the scholarship that they form a virtual consensus on this Summa passage’s teaching.6This proliferation of such statements on Aquinas’s meaning, however, contrasts sharply with the absence of careful analyses [End Page 426] of the passage. I do not know, in fact, of a single article, book chapter, or study that takes Nietzsche’s quotation of Aquinas for its theme. More generally, despite the vast literature on Nietzsche and Christianity, comparative studies of Nietzsche and Aquinas are rare.7 The absence of substantive studies on the Genealogy’s use of the Aquinas quotation is doubly unfortunate. First, it silences or at least muffles the voice of Nietzsche. He cites Aquinas’s text in the specific context of Treatise I of the Genealogy. The quotation reveals the full meaning that Nietzsche intended it to convey only when it is read in that context. Second, it obscures and distorts the thought of Aquinas: the quotation must be read in its own context in the Summa theologiae to grasp the teaching that Aquinas intended his words to express.In light of Aquinas’s importance as a Christian theologian and the crucial role he plays in the Genealogy’s critique of moral values, I intend to examine Nietzsche’s presentation of this text. Careful study of this matter can shed light on a key question which has long been discussed and debated: Is Nietzsche’s account of Christianity as life-inimical rooted in an extraordinarily perceptive reading of the Christian psyche? Or is it based, rather, on a profound misunderstanding of that psyche? I will argue for two points: (1) that Nietzsche has utterly misconstrued Aquinas’s teaching; and (2) that Aquinas’s Christian morality, far from being life-inimical, is life-affirming. In lieu of an abstract, here is a brief excerpt of the content:Rediscovering the Imprecatory Psalms:A Thomistic ApproachGabriel Torretta O.P.WHILE DEBATING the structure of the new Liturgy of the Hours, some members of the Consilium for the Implementation of the Constitution on the Liturgy (Consilium ad exsequendam Constitutionem de Sacra Liturgia) drew attention to certain so-called imprecatory psalms1 that contained material they deemed problematic for the modern person of prayer, describing the passages as “offensive to modern sensibilities”2 and arguing that (...) the “spiritual discomfort caused by expressions of anger and revenge... is felt especially by the younger people and by those who say the Office in the vernacular.”3 After a great deal of debate about whether these concerns justified the removal of certain psalms from the Liturgy of the Hours,4 Pope Paul VI decreed that “a selection be made of psalms better suited to Christian prayer and that the imprecatory and historical psalms be omitted,” without further [End Page 23] specification.5 To this end, 120 verses were omitted from the Liturgy of the Hours text,6 comprising three whole psalms and additional verses from nineteen others.7 In explaining the decision, the General Instruction of the Liturgy of the Hours makes the following statement:Three psalms (58[57], 83[82], and 109[108]) have been omitted from the Psalter cycle because of their curses; in the same way, some verses have been omitted from certain psalms, as noted at the head of each. The reason for the omission is a certain psychological difficulty, even though the psalms of imprecation are in fact used as prayer in the New Testament, for example, Rv 6:10, and in no sense to encourage the use of curses.8The concern about the suitability of certain strident verses from the Psalter for contemporary prayer noted in this passage [End Page 24] is not limited to texts for Roman Catholic worship; the current editions of the United Methodist Hymnal, the Revised Common Lectionary, and the Episcopal Sunday Lectionary have also omitted certain of the imprecatory psalms and edited out a number of verses in others.9 A question naturally emerges from this common concern about imprecation in public prayer: Does the “psychological difficulty” raised by certain passages of the Psalter mean that Christians cannot or may not any longer pray the psalms of imprecation publically?This question, pressing as it may be for compilers of liturgical books and those who recite the Psalter as part of their daily lives of prayer, has been surprisingly neglected in the scholarly realm. In our conception, a sharing in the misery of another stands as an essential element of authentic mercy. Hence, our untutored experience may incline us to press Aquinas and to ask, Why, exactly, does sorrow over the misery of others not belong to God? If one seeks clarification regarding this point within the abovementioned passage, one does not find it. Aquinas does not here expound at any length upon the reasons why God does not share the misery of the miserable.Thankfully we are not the first students of theology to approach the writings of Aquinas. Nor are we the first to observe the prima facie oddness of a seemingly impassive God within Aquinas’s consideration of mercy. Throughout history, theologians of profound elegance and insight have sought wisdom from the Angelic Doctor. Some have even devoted their academic lives to the task of studying, expounding, and “commenting” upon the Thomistic text. In this essay, we intend to rely upon—and thereby highlight—a few of the valuable insights into divine mercy these Thomist commentators offer within their commentaries. Because the Thomist commentatorial tradition includes far too many figures to summarize in a few pages, we have decided to draw from only a small handful of the major Thomist commentators within a limited period of theological history, roughly from the sixteenth through the eighteenth centuries.4 Moreover, while the Thomist commentators exhibit a wide range of uniqueness and nuance amongst themselves, we might observe in our analysis a fundamental first principle uniting these major figures: the real distinction between act and potency (as well as between form and matter). His being admits to no potentiality and no passivity within himself. The seventeenth-century Carmelite commentators, the Salmanticenses, note the relevance of the act-potency distinction for understanding the divine mercy: “In God, mercy is not given through the mode of a potency, but through the mode of the highest actuality... which extends to the relieving of all misery.”6 The defect of misery requires some degree of potentiality and passivity within its subject. In 1904, the last January issue of the newspaper “Moskoskiye vedomosti” carried an article by Alexey I. Vvedensky, philosopher and theologian, Professor of the Moscow Theological Academy, entitled “The Great Rationalist. On the Centenary of Kant’s Death”. Although the publication could hardly be called unique for its time, as many Russian philosophers and journalists commented on this date, the article merits attention because of the way it represents Kant, and the fact that it sheds light on Vvedensky’s attitudes toward Kantian (...) philosophy. Alexey Vvedensky is to this day a little-known figure in the history of Russian philosophy, such that I thought it would be helpful to preface the publication with a review of the landmarks in the Russian philosopher’s intellectual biography. I go on to demonstrate the ambivalent character of Vvedensky’s attitudes toward Kant’s philosophy. To this end, I show that the Russian philosopher, on one hand, calls for a “return to the universally acclaimed Kant”, whose genius he unreservedly recognises; and on the other hand, he argues that Kant should not only be studied and profoundly reflected on, but also overcome because his rationalism “has desiccated the thought of the new cultured humanity”. This paper presents a longue durée account of the discursive emergence of ‘the market'. It seeks to develop understanding of the ‘crisis system' by showing that the crises of the present have their origins earlier than some critical realist scholars have suggested and can be better understood by the theorization of the generative mechanisms that emerged from the economic and political chaos of the early 1600s. Critical discourse analysis (CDA) is employed to show that in the context of the emergence (...) of capitalism in England, these generative mechanisms resulted in the meaning of the word ‘market’ slipping loose of the geo-spatial semiotic bounds by which it had commonly been delineated – i.e. as a physical space in a town or city where goods were bartered or sold – and being re-semioticised to refer to abstract space where all acts of capitalist economic exchange, including those impacting upon the natural world, take place.
